What Gilbert Allows on Your Lot
Gilbert rewrote its casita rules to follow Arizona’s ADU law (A.R.S. § 9-461.18). These are the numbers that shape most Gilbert plans. Your zoning and lot can change them, so we confirm everything for your address before you spend on design.
Sources: A.R.S. § 9-461.18 and the Town of Gilbert Planning Commission staff report on its ADU code update. Rules change, so confirm with us before you rely on this for your lot.

What’s Different About Building in Gilbert
The old setback rules no longer apply
Before the state law, Gilbert required secondary units to meet the main home’s setbacks, which meant 30 ft on the sides and 40 ft at the rear on acre lots. Casitas are now capped at 5 ft side and rear setbacks, so lots that couldn’t fit one before often can now.
No public hearing
A casita is a permitted use in Gilbert. Planning reviews it only to confirm it fits zoning. The exception is a casita over 1,000 sq ft, which goes through the administrative use permit process.
Rentals and relatives
Gilbert can’t ban long-term rental of a casita, and state law doesn’t require the renter to be related to you or the owner to live on site.
HOAs still count
Many Gilbert neighborhoods are HOA communities. State law lets an HOA whose existing rules prohibit casitas keep enforcing them, so we check your CC&Rs early.
Easements and airport areas
A casita can’t be built over a utility easement without the utility’s written consent, and areas near certain airports are exempt from the state law. We check both for your address.
We Check Your Lot First
Zoning, setbacks, height step-back, easements and HOA rules, confirmed for your address before you pay for design.

Gilbert Casita Questions
How big can a casita be in Gilbert?
Up to 1,000 sq ft or 75% of the main home’s gross floor area, whichever is less. A larger casita goes through Gilbert’s administrative use permit process.
How many casitas can I build on a Gilbert lot?
One attached and one detached ADU on any lot where a single-family home is allowed. An additional detached ADU is allowed on a lot of at least one acre if at least one unit is restricted-affordable.
How close to the property line can a Gilbert casita be?
Rear and side setbacks for a casita can’t be more than 5 feet. Gilbert applies a step-back for taller casitas, adding one foot of setback for every foot of height above 10 feet.
Do I need extra parking for a casita in Gilbert?
No. Arizona law bars towns from requiring additional parking for a casita or charging a fee in place of parking.
Can I rent out my Gilbert casita?
Gilbert can’t prohibit renting a casita on a long-term basis (90 days or more, or month-to-month), and the renter doesn’t have to be related to you. Short-term rental rules are separate, so check them before planning on that income.
Can my HOA stop me from building a casita?
If your HOA’s existing rules prohibit casitas, state law lets it keep enforcing them. We review your CC&Rs at the start so there are no surprises.
Does Maricopa Casitas handle Gilbert permits?
Yes. We prepare the plans and manage the review and permit process with the Town of Gilbert as part of your build.
